Montgomery County District Clerk

The Montgomery County District Clerk's office manages all felony criminal filings for the county. The office is located at 301 N. Main Street, Suite 103, Conroe, TX 77301. Mailing address: P.O. The Records and Research Department within this office maintains civil, family, felony, and delinquent tax files going back to the 1900s. Staff is available to help you locate older cases by name or cause number. For criminal matters specifically, Bridget handles cases for the 369th and 87th courts, while the office has staff assigned to each court division to manage filing volume.

Records can be requested in person or by mail. Use the "Request for Copies" form for standard requests. Plain copies cost $1.00 per page. Certified copies are $1.00 per page plus a $5.00 certification fee per document. The office does not accept personal business checks. Cash, money orders, and cashier's checks are all accepted. Credit and debit card payments are also available with a $2 minimum transaction fee. Criminal name searches within Montgomery County cost $5.00 per name per 10-year search period.

For bulk records or electronic data, the office provides civil and criminal case data by CD, FTP file, or email for $9.35 per request. Fax requests are not accepted. By law, the office has 10 business days to respond to records requests, though the stated goal is 4 to 5 business days.

District Courts Handling Montgomery County Felony Cases

Montgomery County has 21 courts. Felony criminal cases are primarily handled by the 435th District Court, which is the dedicated Criminal District Court for the county. Additional district courts also have jurisdiction over felony matters, including the 9th, 221st, 284th, 359th, 418th, and 435th District Courts. All of these courts sit at the Montgomery County Courthouse complex in Conroe.

The main courthouse is at 301 North Main Street and West Davis Street in Conroe. It is a three-story limestone, brick, and concrete structure. The Atrium Building at 210 West Davis Street contains four County Court at Law courtrooms and connects to the main courthouse by a skywalk. The Lee G. Allworth Building at 507 West Phillips Street houses three additional District Court courtrooms. Knowing which building hosts your court before you go saves time.

Under the Texas Penal Code, capital felonies carry life in prison or death. First-degree felonies carry 5 to 99 years or life. Second-degree felonies carry 2 to 20 years. Third-degree felonies carry 2 to 10 years. State jail felonies bring 180 days to 2 years. All levels flow through the Montgomery County district courts and are indexed by the District Clerk from the time of indictment through final disposition.

You can search by case number, party name, attorney name, or date filed. The index is free. For court case images, you need to complete a registration form to access document scans. The county also provides a searchable Court Docket for both County Court and District Court proceedings. This lets you see scheduled hearing dates, recently filed cases, and case status. Dockets are useful if you want to confirm a hearing date or check where a case stands in the court process.

The statewide re:SearchTX portal covers Montgomery County as part of its 254-county system. This is the official portal run by the Texas courts system. The County Clerk maintains Official Public Records going back to 1836. These include deeds, land patent records, mortgages, judgments, and tax liens. For felony research purposes, the County Clerk's office is less central than the District Clerk's, but it holds misdemeanor criminal records and some older court case files. The County Clerk also handles vital records, marriage licenses, and probate filings.

If you are not sure which office holds the record you need, call the main county number and ask which clerk's division handles your case type. Misdemeanors go to the County Clerk. Felonies go to the District Clerk.

Justice of the Peace Courts in Montgomery County

Montgomery County has four JP precincts. Precinct 1 is Judge Wayne L. JP courts handle Class C misdemeanors, small claims, and civil matters up to $20,000. They do not hear felony cases. If you have a ticket or minor offense citation from anywhere in Montgomery County, the JP courts are where that gets resolved.

Statewide Resources for Montgomery County Records

The Texas DPS Crime Records Service allows anyone to run a name-based criminal history search for $3 per search. This covers all convictions reported to the state, including Montgomery County felony dispositions. Create a CRS Public Website Account at the DPS website to get started. Fingerprint-based searches are more reliable and required for formal employment or licensing background checks.
